1. About These Terms

1.1 What These Terms Cover

These Terms govern access to and use of www.xyston.com.au, operated by Xyston Pty Ltd. They form a legally binding agreement between users and the company.

1.2 Additional Terms

Some Site sections may have additional terms (Privacy Policy, Service Agreements). Where conflicts exist, additional terms take precedence for specific services.

1.3 Relationship to Service Agreements

These Terms cover Site use only. Participants receiving NDIS services have separate Service Agreements governing those deliverables. These Terms do not replace service-specific rights.

1.4 Plain Language Commitment

Xyston commits to clear, understandable language and offers accessible formats upon request.

2. Who Can Use the Site

2.1 Eligibility

Users must be 18+ or have parental/guardian consent. Organisational representatives must have authority to bind their entities.

2.2 Representatives and Nominees

Guardians, plan nominees, and authorised representatives need legal authority to act on behalf of others, including NDIS participants.

2.3 Supported Decision-Making

The company supports disability rights principles and encourages supported decision-making aligned with NDIS Code of Conduct standards.

3. How You May Use the Site

3.1 Permitted Use

Limited, non-exclusive, non-transferable licence granted for personal, non-commercial purposes. Users may download and print materials if copyright notices remain intact.

3.2 Prohibited Conduct

Prohibited activities include unlawful use, system interference, unauthorised data collection, unauthorised access attempts, malware transmission, spam distribution, defamatory content posting, and intellectual property infringement.

3.3 Your Responsibilities

Users must maintain account security, provide accurate information, and report suspected breaches promptly.

4. Intellectual Property Rights

4.1 Ownership

All content on the Site — including text, graphics, logos, icons, images, videos, audio, data, page layouts, code, and software — is protected under Australian intellectual property law.

4.2 What You May Do

Users may view, download, and print for personal use while preserving copyright notices.

4.3 What You Must Not Do

Copying, reproducing, distributing, selling, reverse-engineering, or using content/trademarks for commercial purposes is prohibited without express authorisation.

4.4 Third-Party Content

Third-party views don't represent Xyston's position. The company isn't responsible for third-party content accuracy.

4.5 Reservation of Rights

All ungranted rights remain reserved to Xyston.

5. Disclaimers and Limitations of Liability

5.1 Your Consumer Rights Are Protected

Australian Consumer Law guarantees cannot be excluded, including services provided with due care, skill, and reasonable timeliness.

5.2 General Information Only

Site content provides general information only, not legal, financial, medical, or professional advice.

5.3 Site Availability

While reasonable steps maintain availability, uninterrupted or error-free access isn't guaranteed.

5.4 Limitation of Liability

Indirect or consequential loss liability is excluded where permitted by law. Total liability caps at $100 or amounts paid within 12 months.

5.5 Force Majeure

Events beyond reasonable control (natural disasters, government actions, cyber-attacks) exempt Xyston from obligation performance.

6. Privacy and Personal Information

Xyston protects personal information under the Privacy Act 1988 (Cth) and Australian Privacy Principles, with particular care for health and disability information. See our Privacy Policy for full details.

7. Third-Party Websites and Services

Third-party links are provided for convenience. Xyston doesn't control, endorse, or accept responsibility for external sites. Users should review third-party privacy policies before providing information.

8. NDIS Specific Provisions

8.1 Our Regulatory Obligations

Xyston complies with the National Disability Insurance Scheme Act 2013, NDIS Code of Conduct, and Practice Standards.

8.2 Participant Rights

NDIS participants have statutory rights to choice, dignity, privacy, accessible information, and complaint access without retribution.

8.3 Accessible Information

Services are provided in Easy Read, large print, high contrast, verbal, and translated formats upon request.

8.4 Service Descriptions

Service descriptions are general. Individual Service Agreements specify actual supports received.

9.3 Advocacy

Users have rights to advocates. The National Disability Advocacy Program (1800 880 052) provides referrals.

10. Changes to These Terms

Minor changes take effect immediately upon posting. Material changes require 30 days' written notice. Continued use after changes indicates acceptance. Updates apply prospectively only.

11. Governing Law and Dispute Resolution

Western Australian and Commonwealth laws govern these Terms. Parties agree to good-faith negotiation within 30 days, then mediation consideration before formal legal proceedings.
